Self Declaration Mark/Compulsory Registration Scheme /Registration Mark/Standard Mark

Ministry of Electronics & Information Technology (MeitY) has notified “Electronics and Information Technology Goods (Requirement for Compulsory Registration) Order, 2012”, mandating Indian Safety Standards for the notified goods under the registration scheme notified by BIS issued under the ambit of BIS Act, 1986 under Gazette Notification no. S.O. 2357(E) dated 7th September 2012.

As per the Compulsory Registration Order 2012 issued by MeitY Manufacturers have to apply for Compulsory Registration Scheme with BIS after getting their products tested from BIS Recognized labs. 

Note: No person shall manufacture or store for sale, import, sell or distribute goods which do not conform to the Indian standard specified in the order as laid down by Bureau of Indian Standards.

Bureau of Indian Standards is the licensing authority for the products covered under Toy Control Order. BIS has initiated the process of grant license to manufacturers of toys for use of BIS Standard Mark as per Scheme I of Schedule II of the BIS (Conformity Assessment) Regulations, 2018.The certification will be done as per Option 1 (Normal Procedure) i.e. after receipt of application, BIS will conduct factory inspection and draw samples for testing in BIS Recognized Labs.

As per  TOY (QUALITY CONTROL) ORDER 2020, issued vide S.O. 853 (E) Products or toys or material designed or clearly intended whether or not exclusively for use in play by children under 14 years of age or any other product as notified by the Central Government of India from time to time.

The provisions and requirements under this order are also applicable to Toys as they are initially received by the children as well as when after a toy is subjected to reasonably foreseeable conditions of normal use and abuse unless specifically noted otherwise.

This order is applicable to domestic and importer products placed in the Indian Market and is not applicable on products which are meant for export.

Process to a Regulatory Dossier

In the last decade, through hundreds of Electronics & IT regulatory submissions and approvals, , working with global regulatory teams and offices and hand holding the biggest , the best the most respectable and the most popular brands in the Electronics & IT business, NKG team has established a tried and tested , yet simple way of preparing the Electronics & IT regulatory dossier for product registration in India.

Process:
  1. Share the technical specification of your product with NKG.
  2. If your product comes under the scope of BIS (Bureau of Indian standards), then necessary list of documents will share with you.
  3. Apply online for login credential’s from BIS 
  4. Taking samples from the manufacturer for testing
  5. NKG will test your product with BIS recognized and NABL approval lab.
  6. After testing test report will submitted at BIS online.
  7. After receiving your signed documents and original test report, NKG team leader will scrutinized application thoroughly.
  8. If all documents are in order w.r.t application and test report then NKG will apply online for fresh registration at BIS.
  9. After receiving the application at BIS department will assign an officer.
  10. The officer securitizing all submitted documents, if all documents and test report are ok then process further, otherwise they will raised the query for clarification. 
  11. If everything is correct in application file, then Dealing officer will recommend the file for grant.
  12. Granting officer will grant the file and the registration no.(R-xxxxxxxx) is generated and get certificate
AS IMPORTER OR MANUFACTURER

REGISTRATION UNDER THE PCR RULES 2011

As per THE LEGAL METROLOGY (PACKAGED COMMODITIES) RULES 2011, Registration of Importer, Packer or Manufacturer is mandatory under the packaged commodity Rule 2011 With Legal Metrology wing under Ministry of Consumer affairs 

Pre-packaged or pre-packed is a commodity which without the purchaser being present is placed in a package of whatever nature, whether sealed or not so that the product contained therein

A application has to be made for approval under Packaged commodity rules 2011 for Registration of Importer, Packer or Manufacturer as per Chapter VI of the Packaged commodity rule (PCR) 27 of legal metrology act 2009:

Every individual, firm, Hindu undivided family, society, company or corporation who or which pre-packs or imports any commodity for sale, distribution or delivery shall make an application, accompanied by a fee of rupees five hundred, to the Director or the Controller for the registration of his or its name and complete address

AUTHORISED INDIAN REPRESENTATIVE (AIR)

In India, overseas Brand cannot submit an application for registration as applicants except the brand owner and manufacturer are same. Having an Indian Entity is mandatory in order to submit an application for registration of imported Electronics & IT. A registration certificate once issued to an overseas manufacture holder and an Indian Entity can be used by only such companies to import products in India.

What is FMCS?

This is a certification scheme for a Foreign manufacturer who wants to obtain BIS Licence. The scheme is for certification of products other than Electronic and Information Technology Products.

Whether BIS License is mandatory to import products in India?

Generally certification scheme of BIS is voluntary in nature, however for certain products as notified by Government of India under Quality Control Orders, they can be imported to India only with Standard Mark under a valid licence from BIS. What is the method of Packing & Marking Product Post Certification?

The Standard Mark, as given in the Schedule of the licence, shall be marked either on the primary packaging or on the toy itself legibly and indelibly, provided always that material so marked conform to requirements of the specification.

Packing and marking/labelling including warnings and other instructions and information required to be provided (for assembly, maintenance etc.) shall be done as per the provisions of the Indian Standard.

What is Series?

For the purpose of certification, all the models of toys of similar design, made from the same materials and covered under a single sub-category, shall be considered as a series. A declaration to this effect shall be made by the manufacturer stating that these models in the same series are of similar design, made from the same materials and covered under a single sub-category. This declaration shall be submitted to BIS along with the application for Grant of Licence (GOL) and Change in Scope of Licence (CSoL) (As per format at APPENDIX II)

What can be considered as “similar design” ?

Similar Design pertains to models which have similar designs in terms of compliance to the safety requirements specified in the relevant Indian Standards. For electric toys, input source, mains layout etc as given in the table above will also constitute design parameters.

What can be considered as “same material”?

Same material pertains to material of the same nature (i.e. LLDPE or PVC or HDPE or Cotton Fabric etc.) and the same dyes and pigments.

How to apply for BIS License?

The application can be made in the forms and formats available under FMCS with all relevant documents indicated in the application. BIS is making a provision to apply on line in due course of time.

Whether nomination of AIR is mandatory?

Yes, the foreign applicant has to nominate an Indian Resident as an Authorized Indian Representative (AIR) while submitting the application.

Is the payment to be made to BIS in USD or INR?

For SAARC countries, the payment can be made in USD or Indian Rupee (INR) with GST. For other countries, the payment should be made in USD only.
