Understanding Mark, Logo & Contents of the Approval

In our last article, we discussed the scope of mandatory registration of devices. Going ahead and equally important is the aspect of understanding if there are any Mark or logo recommended on the device.

One big objective of the Legal Metrology Act is the protection of consumer interest, ensuring consumer ease, increasing consumer understanding so that a consumer does not make an error in judgment while consuming a packaged commodity.

Under the Legal Metrology (MODEL APPROVAL) RULES 2011, Here we discuss about the stamping or logo or mark after getting approval

As per the rule 19 chapter III of model approval legal metrology 2011 “The mark assigned to the model shall contain the national identification letters, namely, IND, the last two digits of the year of the issue (for example, 77), the code number assigned  to the laboratory and the  code number assigned to the model.”

In simple words, after licence you must impose the assigned mark on your product, which indicates the product is certified from the lab, thereby gaining trust of the  consumers.

There are few points need to be observed at the time of imposing Mark on a product :

  • The mark should be legible or clear
  • The mark must not be removable.
  • Manufactured by: should be mentioned on the product, which helps to identify the manufacturer easily.

The Main contents present on the Certificate of model approval are
  • the number of the certificate
  • a brief description of the model
  • the mark assigned to the approved model
  • the category of weight or measure
  • a brief statement of the results of the tests
  • The place or places where the verification seal or stamp or both may be affixed.
  • The certificate of approval shall become on and from the date of its publication in the Official Gazette.
  • The Director shall cause the necessary model certificate to be published in the Official Gazette.

Suspension of certificate ‘of approval. 

Yes, the Director or Controller can suspend a certificate of approval in the event of deviation or failure of in meeting the rules or standards laid in the act.
