BUREAU OF INDIAN STANDARDS (BIS) and CORE ACTIVITIES OF BIS

In January 1947, the Indian Standards Institution (ISI), as the then national standards body of India, was registered as a Society under the Societies Registration Act, 1860.

Later, its mandate was expanded to include Product Certification activity through the Indian Standards Institution (Certification Marks) Act, 1952.In the mid 1980’s it was felt necessary to confer a statutory status to ISI’s functioning which led to the enactment of the BIS Act 1986. ISI was renamed as the Bureau of Indian Standards (BIS), to promote harmonious development of standardization, and quality certification of goods, with clearly defined statutory powers.

The Bureau of Indian Standards (BIS) is working under the aegis of the Ministry of Consumer Affairs, Food & Public Distribution, Government of India. It is established by the Bureau of Indian Standards Act, 1986 which came into effect on 23 December 1986.

The Act has now been revised dated 22 march 2016 as BIS Act, 2016 and establishes BIS as the National Standards Body, has been brought into force w.e.f 12 october 2017.The BIS Act 2016, Rules and Regulations framed there under authorizes BIS to undertake conformity assessment of products, services, systems and processes. Under the product certification scheme – I, BIS grants licence to use the standard mark or grants certificate of conformity as per conformity assessment schemes given in BIS (Conformity Assessment) Regulations, 2018 . The conformity assessment schemes are laid down in BIS (Conformity Assessment) Regulations, 2018 which are based on principles laid down in IS/ISO/IEC 17067: 2013.

Types of REGISTRATIONS

The ISI mark is a standards-compliance mark for industrial products in India since 1955. The mark certifies that a product conforms to an Indian standard (IS) developed by the Bureau of Indian Standards (BIS), the national standards body of India.

The Directorate General of BIS, Ministry of Consumer Affairs, Food & Public Distribution, Government of India is the Central Licensing Authority for products covered under Scheme-1 in case of Products manufactured in and out of India.

FMCS is a scheme introduced by BIS for foreign manufacturers who want to establish their products in Indian market and promote globalization , NKG will help to get ISI mark for such products which are introduced by BIS for ISI mark.BIS will audit at manufacturing premises and confirm the quality of the product and ensure the safety of consumer.

Authorised indian representative (AIR)

Under FMCS- Foreign Manufacturer certification Scheme, Manufacturer has to assign Indian 

Agent Representative for the application.

The Authorized Indian Representative (AIR) shall be an Indian resident. He shall declare his consent to be responsible for compliance to the provisions of the BIS Act, Rules, Regulations and Terms & Conditions laid down in BIS License, Agreement, Undertaking etc. executed by or on behalf of the foreign manufacturer in connection with grant and operation of the license.

AIR is representative of one manufacturing firm only and doesn’t represent other foreign manufacturer(s) as AIR under the BIS Conformity Assessment schemes. However, in case of foreign manufacturers belonging to one group of companies and importers (related to the foreign manufacturer) nominated as AIR, the restriction shall not be applicable.

The Incharge of the branch /office in India of the foreign manufacturer or a senior person of the branch/office shall be nominated as the AIR. In case, there is no such branch / office established in India or till it is established in India , the foreign manufacturer shall nominate an AIR in the prescribed format on its letter-head.

In case of change of the AIR and/or his address, the manufacturer shall be required to inform BIS in advance.

AIR(s) shall not have any conflict of interest with respect to their role as AIR with testing of sample(s) in third party laboratories.

AIR(s) shall be preferably at least graduate by qualification and shall understand the provisions of BIS Act, 2016 and rules, regulations framed thereunder and the implications thereof.

What is FMCS?

This is a certification scheme for a Foreign manufacturer who wants to obtain BIS Licence. The scheme is for certification of products other than Electronic and Information Technology Products.

Whether BIS License is mandatory to import products in India?

Generally certification scheme of BIS is voluntary in nature, however for certain products as notified by Government of India under Quality Control Orders, they can be imported to India only with Standard Mark under a valid licence from BIS. What is the method of Packing & Marking Product Post Certification?

The Standard Mark, as given in the Schedule of the licence, shall be marked either on the primary packaging or on the toy itself legibly and indelibly, provided always that material so marked conform to requirements of the specification.

Packing and marking/labelling including warnings and other instructions and information required to be provided (for assembly, maintenance etc.) shall be done as per the provisions of the Indian Standard. 

In addition, the model number and the following shall be incorporated on each package:

  1. BIS Licence Number CM/L ………….and
  2. BIS website details i.e. ―For details of BIS certification please visit www.bis.gov.in
What is Series?

For the purpose of certification, all the models of toys of similar design, made from the same materials and covered under a single sub-category, shall be considered as a series. A declaration to this effect shall be made by the manufacturer stating that these models in the same series are of similar design, made from the same materials and covered under a single sub-category. This declaration shall be submitted to BIS along with the application for Grant of Licence (GOL) and Change in Scope of Licence (CSoL) (As per format at APPENDIX II)

What can be considered as “similar design” ?

Similar Design pertains to models which have similar designs in terms of compliance to the safety requirements specified in the relevant Indian Standards. For electric toys, input source, mains layout etc as given in the table above will also constitute design parameters.

What can be considered as “same material”?

Same material pertains to material of the same nature (i.e. LLDPE or PVC or HDPE or Cotton Fabric etc.) and the same dyes and pigments.

How to apply for BIS License?

The application can be made in the forms and formats available under FMCS with all relevant documents indicated in the application. BIS is making a provision to apply on line in due course of time.

Whether nomination of AIR is mandatory?

Yes, the foreign applicant has to nominate an Indian Resident as an Authorized Indian Representative (AIR) while submitting the application.

Is the payment to be made to BIS in USD or INR?

For SAARC countries, the payment can be made in USD or Indian Rupee (INR) with GST. For other countries, the payment should be made in USD only.
